Terms and Conditions
§1 Definitions

Terms and Conditions – these terms and conditions of the Plantway online store.

Store – the Plantway online store, operated at the web address www.waaytogo.com.

Seller – Plantway Sp. z o.o., ul. Geodetów 33, 05-200 Wołomin, Poland, Tax ID (NIP): 1251706258, National Court Register (KRS): 0000844806, e-mail address: kontakt@plantway.pl, phone number: +48604540174.

Customer – a natural person, legal person, or an organizational unit without legal personality, to which special regulations grant legal capacity, placing an order within the Store.

Consumer – a Customer who is a natural person making a purchase in the Store not directly related to their business or professional activity.

Entrepreneur with Consumer Rights – a natural person running a sole proprietorship, entering into a contract directly related to their business activity, if the content of such contract indicates that it does not have a professional character for them.

Goods – food products (protein shake) as well as other physical or digital products available in the Store and constituting the subject of the Sales Agreement.

Sales Agreement – a distance sales agreement for Goods concluded between the Customer and the Seller via the Store.

Order Form – an interactive form available in the Store, enabling the placement of an order, in particular by adding Goods to the cart and defining the terms of the Sales Agreement, including the method of delivery and payment.

Electronic Services – services provided electronically by the Seller to the Customer via the Store.
§2 General Provisions

The Terms and Conditions define the rules for using the Store, including the rules for concluding Sales Agreements, payment methods, delivery, and the complaint procedure.

Using the Store requires acceptance of these Terms and Conditions. The Customer is obliged to read the Terms and Conditions before placing an order.

Sending unlawful content via forms in the Store is prohibited.

Prices of Goods in the Store are given in Polish Złoty (PLN) and include VAT. These prices do not include delivery costs, which are indicated to the Customer during the placement of the Order.

Information about Goods provided on the Store's websites, in particular their descriptions and prices, constitutes an invitation to conclude a contract within the meaning of Article 71 of the Civil Code.
§3 Orders and Payments

Orders in the Store can be placed 24 hours a day, 7 days a week.

After selecting the Goods, the Customer should take subsequent steps in accordance with the messages displayed on the Store's pages to finalize the order.

The order is placed after the Customer clicks the “Buy and pay” button or an equivalent, which means the conclusion of the Sales Agreement and the Customer's obligation to make the payment.

After placing an order, the Seller immediately confirms its receipt by sending an appropriate e-mail to the address provided by the Customer, which means the conclusion of the Sales Agreement.

Payments for orders are handled by the mBank Paynow payment gateway. The Customer can make payments using:

Fast online transfers (Pay-by-link).

Payment card.
-
BLIK.

- The entity providing online payment services for payment cards is Autopay S.A.
- Available payment methods: Payment cards: Visa, Visa Electron, Mastercard, MasterCard Electronic, Maestro.
- The order fulfillment time is calculated from the moment of obtaining positive payment authorization.
- In the event of a refund for a transaction made by the customer with a payment card, the seller will make the refund to the bank account assigned to the Customer's payment card.

The Customer is obliged to make the payment within 5 business days from the date of concluding the Sales Agreement. In the absence of payment, the order may be cancelled.
§4 Conditions for Providing Electronic Services

The Seller provides Electronic Services to Customers, which consist of operating the Online Store, including making the Order Form available.

The provision of Electronic Services is free of charge.

Technical requirements necessary to use the Store include Internet access, a standard web browser, and an active e-mail account.

To file a complaint regarding the functioning of Electronic Services, the Customer should contact the Seller by e-mail at kontakt@plantway.pl. The complaint should include the name, surname, correspondence address, and a description of the reported irregularity.

The Seller will consider the complaint within 14 days from the date of its receipt.
§5 Delivery

Delivery of Goods takes place within the territory of the Republic of Poland.

Delivery costs are added to the order value and are visible in the Order Form.

Delivery of Goods is possible via courier companies and to parcel lockers (paczkomaty).

The delivery time for Goods to the Customer is up to 5 business days, unless a different time is specified in the description of the given Good or during the placement of the Order. The delivery time is calculated from the day the payment is credited to the Seller's account.

The Seller is not responsible for damage to the Goods resulting from the Customer failing to collect the package or redirecting the shipment at their own risk.
§6 Complaints

The Seller is obliged to deliver Goods without defects to the Customer.

In the event that the Good has a defect (e.g., it is damaged, spoiled), the Customer may file a complaint based on the provisions of the Consumer Rights Act.

To file a complaint, the Customer should contact the Seller via e-mail at: kontakt@plantway.pl or by phone at +48604540174.

In the complaint notification, the Customer should provide their contact details, order number, a description of the defect, and their request (e.g., replacement of the Good with a defect-free one).

The Seller will consider the complaint within 14 days from the date of its receipt and inform the Customer about their decision.

§7 Exceptions to the Right of Withdrawal (Returns)

In accordance with Article 38 point 4 of the Consumer Rights Act, the right to withdraw from a distance contract is not granted to the Consumer with regard to contracts where the subject of the service is a product that is subject to rapid spoilage or has a short shelf life. The protein shake, being a food product, is treated as a product subject to rapid spoilage.

The right to withdraw from the contract is also not granted for Goods delivered in sealed packaging which cannot be returned after opening due to health protection or hygiene reasons (Article 38 point 5 of the Act).

In connection with the above regulations, the Consumer is not entitled to return the Goods without giving a reason.

The above provision does not infringe upon the right to file a complaint due to defects in the Goods, as referred to in §6 of the Terms and Conditions.

In the event of failure to collect the shipment containing perishable products, the Seller is not responsible for their spoilage and will not refund the Customer for these products. The Customer also bears the costs of delivery and return of the shipment.
§8 Privacy Policy and Cookies

The Controller of Customers' personal data collected via the Store is the Seller.

Customers' personal data is processed for the purpose of order fulfillment, as well as for marketing purposes if the Customer has consented to it.

The Store uses cookies to improve the service's performance, personalize content, adjust advertisements, and analyze traffic on the website.

The Customer can manage cookies using their web browser settings.
-
Detailed rules for personal data processing, their recipients, and Customer rights, as well as information about the use of cookies, can be found in a separate document: Privacy Policy, available on the Store's website.
§9 Final Provisions

All rights to the Store and offered Goods, including intellectual property rights and copyrights, belong to the Seller.

The Seller reserves the right to make changes to the Terms and Conditions for significant reasons, such as changes in legal regulations. New terms and conditions enter into force on the day of publication. Customers will be informed about changes to the terms and conditions.

In matters not regulated by these Terms and Conditions, generally applicable provisions of Polish law shall apply.

In case of a dispute, the parties will strive to resolve the matter amicably. The Consumer has the possibility to use out-of-court dispute resolution methods.
